Welcome to Sugar Hill Market. These Terms of Service govern your access to and use of sugarhillmarket.com, including any purchases made through the website.

Throughout these Terms, “Sugar Hill Market,” “we,” “us” and “our” refer to Sugar Hill Market. “You” and “your” refer to the customer, website visitor or other person using our website.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy, and Refund, Return & Cancellation Policy. If you do not agree to these Terms, please do not use the website.

We reserve the right to refuse service, cancel an order, restrict account access or limit product quantities for lawful and non-discriminatory reasons, including suspected fraud, unauthorized resale, payment problems, inventory errors or misuse of the website.

We may update, suspend or discontinue any part of the website or our services without prior notice.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products and services.

3. Products and Availability

We make reasonable efforts to display product descriptions, photographs, colors, weights, quantities, ingredients and prices accurately.

Because computer and mobile-device displays vary, we cannot guarantee that product colors will appear exactly as they do in person. Product shape, color, size, packaging and appearance may vary slightly from photographs.

All products are subject to availability. We reserve the right to:

  • Limit quantities purchased by any customer or household

  • Discontinue a product without notice

  • Correct product descriptions, prices or inventory errors

  • Cancel or refund an order for an unavailable product

  • Refuse orders that appear to be fraudulent or intended for unauthorized resale

4. Food Products, Ingredients and Allergens

Sugar Hill Market sells edible food products, including candy, chocolate, gummies, salt water taffy, confections and snacks.

Ingredient and allergen information is provided using information available from manufacturers, suppliers and product packaging. Manufacturers may change ingredients, formulations, production methods or allergen statements without prior notice.

Customers with food allergies, intolerances, sensitivities or dietary restrictions are responsible for reviewing the product description and current product packaging before consumption. Contact us before purchasing if you have questions about a product.

Unless a product is expressly identified as being produced in an allergen-free facility, we cannot guarantee that it is free from cross-contact with milk, eggs, peanuts, tree nuts, soy, wheat, sesame or other allergens.

Do not consume a product if its packaging or ingredient information conflicts with your dietary needs.

5. Pricing and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

Prices, discounts and promotions may change without notice. We reserve the right to correct pricing, typographical or calculation errors, including after an order is submitted. If an error affects your order, we may contact you, cancel the affected item or issue a refund.

Payment must be completed using one of the payment methods available at checkout. By submitting payment information, you represent that you are authorized to use the selected payment method.

Applicable taxes and shipping charges will be calculated and displayed during checkout.

6. Orders

Submitting an order does not guarantee acceptance. We reserve the right to accept, decline, limit or cancel an order.

An order is considered accepted when payment has been successfully processed and we begin preparing it for shipment.

Customers are responsible for reviewing all product selections, quantities, shipping information and payment information before submitting an order.

7. Cancellations and Changes

All orders are final once submitted. We do not accept requests to:

  • Cancel an order

  • Add or remove products

  • Substitute products

  • Change quantities

  • Change the shipping address

  • Combine separate orders

Because order preparation may begin shortly after purchase, we cannot guarantee that messages sent after an order is placed will be reviewed before fulfillment.

If we must cancel an order because of unavailable inventory, a pricing error, suspected fraud or another fulfillment issue, we will refund the affected item or order.

Nothing in this section limits cancellation or refund rights that cannot legally be waived, including applicable rights involving shipping delays or non-delivery.

8. Shipping and Delivery

Orders are shipped according to our Shipping Policy, which is incorporated into these Terms.

Shipping dates and delivery dates are estimates unless expressly stated otherwise. Delivery may be affected by carrier delays, severe weather, holidays, service interruptions, incorrect addresses or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address and for monitoring tracking information after shipment.

Risk of loss transfers as permitted by applicable law. Questions about damaged, missing or undelivered orders will be handled according to our Shipping Policy and Refund, Return & Cancellation Policy.

9. Warm-Weather Shipping

Chocolate and other heat-sensitive products may soften or melt during transit.

From May through September, ice packs are automatically included with orders containing heat-sensitive products. Ice packs reduce the risk of melting but cannot guarantee that products will remain completely solid throughout transit.

Customers should monitor tracking and retrieve heat-sensitive packages promptly after delivery.

Claims involving melted or heat-damaged products must be submitted within 48 hours of delivery. Each claim will be reviewed individually according to our Refund, Return & Cancellation Policy.

10. Returns, Refunds and Claims

Because our products are edible food items, we do not accept returns or exchanges once an order has shipped.

Claims involving damaged, incorrect, missing, melted or heat-damaged products must be submitted within 48 hours of delivery. Customers may be required to provide photographs of the product, shipping box, internal packaging, shipping label and all items received.

If a claim is approved, we may offer a replacement, store credit, partial refund or full refund, depending on the circumstances, product availability and applicable law.

11. Discounts and Promotions

Discount codes and promotional offers:

  • Must be used before their expiration date

  • May be limited to one per order

  • May exclude certain products or collections

  • Cannot be applied after an order is submitted

  • Have no cash value

  • May not be combined unless expressly permitted

We reserve the right to modify, suspend or cancel a promotion when permitted by law, including in cases of misuse, fraud or technical error.

12. Customer Accounts

You may have the option to create a customer account. You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

Notify us promptly if you believe your account has been accessed without authorization.

We may suspend or terminate an account that is used fraudulently, unlawfully or in violation of these Terms.
